Unregistered trade mark rights in the EU and UK

A comparison of the unregistered rights available to brand owners in the United Kingdom, Benelux and Germany. We compare and contrast the rights which are available to brand owners in those states and how they can be enforced and used in opposition and invalidity proceeding before the various national IP offices and the EUIPO. What is the evidential burden in proving such rights and practical tips on enforcing them.
