HGF is pleased to invite you to our upcoming German-language seminar on “Patent applications and grants in Europe” in Salzburg and Dresden. The seminar provides participants with a comprehensive overview of the patent application and grant process in Europe.

About the Seminar:

In this seminar, participants will gain a detailed introduction to the fundamentals of patent applications and the granting process in Europe. The seminar covers how inventions are identified and assessed, as well as the necessary steps and requirements for a successful patent application. Additionally, it explores the different types of patent protection available in the EU, including national patents, bundle patents, and the Unitary Patent (UP). Strategies for navigating nullity proceedings—such as those in Germany, oppositions at the EPO, and future proceedings at the UPC—will also be discussed. The aim is to provide participants with the knowledge and tools required to select the most suitable patent protection and effectively manage the application, grant, and post-grant phases.

  1. Introduction to the European patent system:
    • Overview of the European Patent Office (EPO) and its role in the European patent system
    • Comparison between national patents, the European bundle patent, and the unitary patent (UP)
  2. Identification of inventions:
    • Definition and characteristics of an invention in the legal sense
    • Cooperation between inventors and patent attorneys for the effective identification and reporting of inventions
  3. Patent application process in Europe:
    • Basic requirements for patentability: novelty, inventive step and industrial applicability
    • Steps and procedures for filing a patent application with the European Patent Office
    • Important deadlines and formalities in the application process
    • Strategies for drafting a strong patent application: patent claims, description, and drawings
  4. Proper patent protection in the EU:
    • Comparison and selection of suitable patent protection: national patent, European bundle patent or unitary patent
    • Advantages and disadvantages of the different types of protection in terms of costs, scope of protection, and administration
    • Practical examples and case studies to help you decide on the right patent protection
  5. Post-grant strategies
    • How should post-grant strategy be changed in light of UP/UPC?
    • Tips for future planning and considerations
    • Choosing between invalidity proceedings in Germany, oppositions at the EPO, or future UPC invalidity proceedings
