USPTO – Artificial Intelligence: Intellectual Property Policy Considerations – Virginia

HGF Partner Lee Curtis will be part of the trade mark panel at the ‘Artificial Intelligence: Intellectual Property Considerations’ conference on the 31st January 2019, run by the United States Patent and Trade mark Office in Alexandria, Virginia.

Artificial intelligence (AI) is expected to produce a new wave of innovation and creativity. At the same time, it poses novel challenges and opportunities for intellectual property (IP) policy, such as:

  • How do we ensure transparency and guard against bias without sacrificing the competitive edge that helps fuel innovation and commercial activity surrounding AI?
  • How will AI alter the management and organization of research, innovation, and commercialization? What are the copyright implications when AI is used to create new works or when copyrighted works are used to “train” artificial intelligence systems?
  • How will AI affect trade mark protection and branding?

Lee Curtis will be part of the panel, “Does AI Dream of Electric Brands?” The discussion of the panel will place the development of AI in historical context and is likely to range over issues such as the impact of AI on issues of confusion, liability in infringement actions and traditional trade mark law concepts such as ‘imperfect recollection’, ‘the average consumer’ and indeed whether AI can be confused.
