The Unified Patent Court (UPC) enables centralized litigation for unitary patents and non-opted-out European patents, offering faster, more cost-effective cross-border enforcement in participating countries.
Unlike the traditional European patent system—which requires national validations, separate renewal fees, and country-specific litigation—the unitary patent system provides one central validation, a single renewal fee, and automatic coverage in 18+ EU states.
An opt-out option is available during a transitional period (until at least 2030), allowing use of the traditional route, suitable for those wanting country flexibility or avoiding centralized revocation risks. Since launch, over 25,000 unitary patents have been registered, with strong adoption in medtech and digital sectors. Germany and the U.S. lead in filings.
Key countries include Germany, France, Italy, and the Netherlands. The UK is not part of the UP or UPC systems.
