Pour les propri\u00e9taires de marques, l&#8217;utilisation d&#8217;influenceurs sur les r\u00e9seaux sociaux peut constituer une strat\u00e9gie pr\u00e9cieuse pour am\u00e9liorer la visibilit\u00e9 de leur marque, de leurs produits et de leurs services. Cependant, en tant que propri\u00e9taire de marque, vous devez toujours \u00eatre vigilant quant \u00e0 la mani\u00e8re dont les influenceurs engag\u00e9s pr\u00e9sentent votre marque afin d&#8217;\u00e9viter l&#8217;attention de l&#8217;Advertising Standard Authority (ASA). Il ne s&#8217;agit pas simplement d&#8217;utiliser #ad, il faut clairement indiquer si les messages sont effectivement promotionnels. Les directives publi\u00e9es par l&#8217;ASA et un r\u00e9cent accord avec la Competition and Markets Authority (CMA) ont clarifi\u00e9 les exigences de conformit\u00e9 dans ce domaine et ont \u00e9galement fourni des indications sur la mani\u00e8re dont les autorit\u00e9s traitent les infractions \u00e0 la r\u00e9glementation.    <\/p>\n<p>Les r\u00e8gles applicables (qui d\u00e9coulent du Code du Committee of Advertising Practice (CAP) et des Consumer Protection Regulations (CPR) 2008) couvrent la publicit\u00e9 pour les produits et services des propri\u00e9taires de marques ainsi que la publicit\u00e9 affili\u00e9e (c&#8217;est-\u00e0-dire lorsqu&#8217;un influenceur est engag\u00e9). Les propri\u00e9taires de marques et les influenceurs peuvent \u00eatre tenus responsables des infractions, il est donc dans l&#8217;int\u00e9r\u00eat des deux parties de bien faire les choses. Pour que l&#8217;ASA (qui est responsable de la r\u00e9glementation des codes de pratique publicitaire) s&#8217;y int\u00e9resse, un influenceur devra \u00eatre \u00e0 la fois r\u00e9mun\u00e9r\u00e9 par le propri\u00e9taire de la marque <strong>et<\/strong> le propri\u00e9taire de la marque doit avoir un certain degr\u00e9 de <em>contr\u00f4le sur les messages de l&#8217;influenceur.<\/em>  <\/p>\n<ul>\n<li><strong>La r\u00e9mun\u00e9ration<\/strong> ne se limite pas aux paiements mon\u00e9taires directs mais inclut \u00e9galement les cadeaux et les avantages en nature.<\/li>\n<\/ul>\n<ul>\n<li>Le <strong>contr\u00f4le<\/strong> est \u00e9galement interpr\u00e9t\u00e9 au sens large pour couvrir toute instruction du propri\u00e9taire de la marque d&#8217;inclure certains contenus, tels que des mots, des phrases, des th\u00e8mes, des messages particuliers ou m\u00eame des actions sp\u00e9cifiques comme le d\u00e9ballage. L&#8217;exigence de certains volumes ou horaires de publication implique \u00e9galement un contr\u00f4le, tout comme le droit de v\u00e9rifier ou d&#8217;approuver le contenu (m\u00eame si ce droit n&#8217;est pas effectivement exerc\u00e9). <\/li>\n<\/ul>\n<p>En l&#8217;absence de paiement et de contr\u00f4le, m\u00eame si les sanctions de l&#8217;ASA peuvent \u00eatre \u00e9vit\u00e9es, la CMA, qui dispose de pouvoirs beaucoup plus importants, peut toujours s&#8217;y int\u00e9resser car les CPR restent applicables.<\/p>\n<p>S&#8217;il y a \u00e0 la fois paiement et contr\u00f4le d&#8217;un influenceur, alors le contenu doit \u00eatre <strong>clairement<\/strong> identifiable comme une publicit\u00e9. De pr\u00e9f\u00e9rence, cela se fait avec une mention bien visible qui doit \u00eatre vue d\u00e8s le d\u00e9but. Il faut \u00e9galement r\u00e9fl\u00e9chir \u00e0 la fa\u00e7on dont cette mention appara\u00eetra sur diff\u00e9rents appareils et si elle est appropri\u00e9e pour le canal utilis\u00e9. Si seule une partie du contenu est promue, seule cette partie doit \u00eatre identifi\u00e9e comme une publicit\u00e9.   <\/p>\n<p>L&#8217;utilisation de <em>Pub, Publicit\u00e9, Annonce publicitaire ou Publicit\u00e9<\/em> sont tous privil\u00e9gi\u00e9s par l&#8217;ASA. <em>Sponsoris\u00e9, en association avec, gr\u00e2ce \u00e0<\/em> (et leurs variantes) ou simplement <em>@marque<\/em> sont plus risqu\u00e9s car consid\u00e9r\u00e9s comme insuffisamment clairs.<\/p>\n<p>Les directives de la CMA, en place depuis 2016, renforcent la n\u00e9cessit\u00e9 pour les annonceurs d&#8217;\u00eatre transparents et honn\u00eates envers les consommateurs, les enqu\u00eates de la CMA pouvant conduire \u00e0 des amendes ou m\u00eame \u00e0 des sanctions p\u00e9nales. La CMA a r\u00e9cemment obtenu des engagements de 16 influenceurs des r\u00e9seaux sociaux pour am\u00e9liorer leurs futures divulgations. Alors que la CMA examine actuellement le r\u00f4le jou\u00e9 par les plateformes (Instagram, Twitter, Facebook, etc.) dans la divulgation des promotions, le non-respect des r\u00e9cents engagements ne serait pas consid\u00e9r\u00e9 favorablement par la CMA, il pourrait donc y avoir de lourdes amendes \u00e0 l&#8217;avenir.  <\/p>\n<p>Si un propri\u00e9taire de marque veut rester du bon c\u00f4t\u00e9 de l&#8217;ASA et de la CMA, il doit s&#8217;assurer de :<\/p>\n<ul>\n<li>sont au courant du contenu publi\u00e9 par les influenceurs avec lesquels ils travaillent et v\u00e9rifient sa conformit\u00e9 ;<\/li>\n<\/ul>\n<ul>\n<li>mettre en place des contrats et des politiques appropri\u00e9s avec les influenceurs pour exiger la conformit\u00e9 ; et<\/li>\n<\/ul>\n<ul>\n<li>fournir une formation, tant en interne qu&#8217;avec les influenceurs, pour que les personnes impliqu\u00e9es dans le processus sachent comment assurer la conformit\u00e9 et connaissent les cons\u00e9quences du non-respect.<\/li>\n<\/ul>\n<p>La publicit\u00e9 par les influenceurs restera importante pour la promotion des marques, des produits et des services.
