Rolex soutient que ces pi\u00e8ces transforment une montre Rolex autrement l\u00e9gitime en un produit contrefait.  <\/p>\n<p>Cela soul\u00e8ve la question de savoir si un produit authentique peut devenir un produit contrefait en raison de pi\u00e8ces de rechange non fournies ou autoris\u00e9es par le fabricant d&#8217;origine.<\/p>\n<p>L&#8217;Organisation Mondiale de la Propri\u00e9t\u00e9 Intellectuelle d\u00e9finit les produits contrefaits comme <em>&#8220;tous les produits portant sans autorisation une marque de commerce identique \u00e0 la marque de commerce valablement enregistr\u00e9e pour ces produits, ou qui ne peut \u00eatre distingu\u00e9e dans ses aspects essentiels de cette marque de commerce, et qui de ce fait porte atteinte aux droits du titulaire de la marque en question.&#8221;<\/em> Dans ce cas, la d\u00e9finition traditionnelle de la contrefa\u00e7on ne semble pas n\u00e9cessairement pr\u00e9sente. La montre elle-m\u00eame porte l\u00e9gitimement la marque Rolex, mais les pi\u00e8ces de rechange &#8220;non-Rolex&#8221; la rendent-elles contrefaite ? <\/p>\n<p>La loi applicable concerne un chevauchement entre les dessins et mod\u00e8les et les marques de commerce. Au Royaume-Uni et dans l&#8217;UE, l&#8217;affaire <em>Acacia<\/em> (EU:C:2017:992) a d\u00e9termin\u00e9 que le design des produits peut \u00eatre copi\u00e9 pour cr\u00e9er des pi\u00e8ces de rechange, \u00e0 condition qu&#8217;elles soient destin\u00e9es \u00e0 la r\u00e9paration et \u00e0 la restauration de l&#8217;apparence d&#8217;origine. Cela chevauche ensuite le droit des marques, car la promotion de pi\u00e8ces de rechange compatibles avec le fabricant d&#8217;origine n\u00e9cessite de faire r\u00e9f\u00e9rence \u00e0 la marque, ce qui soul\u00e8ve la possibilit\u00e9 d&#8217;une contrefa\u00e7on de marque. Ici, Vintage Watchmaker doit vraisemblablement utiliser la marque &#8220;Rolex&#8221; pour permettre aux consommateurs de comprendre que les pi\u00e8ces telles qu&#8217;un cadran ou un bracelet de remplacement peuvent \u00eatre utilis\u00e9es pour leur montre de luxe. Cependant, l&#8217;utilisation de pi\u00e8ces de rechange non marqu\u00e9es changerait-elle l&#8217;\u00e9tat physique des produits commercialis\u00e9s et serait-elle ainsi consid\u00e9r\u00e9e comme une contrefa\u00e7on de marque ?    <\/p>\n<p>Dans une soci\u00e9t\u00e9 de consommation en constante expansion, la contrefa\u00e7on devient de plus en plus r\u00e9pandue, difficile et nuanc\u00e9e pour les d\u00e9taillants et les propri\u00e9taires de marques. Les consommateurs veulent faire de bonnes affaires sur le march\u00e9, ce qui soul\u00e8ve in\u00e9vitablement la possibilit\u00e9 d&#8217;options alternatives moins co\u00fbteuses.
