En octobre 2017, la BBC a diffus\u00e9 le premier programme d&#8217;une s\u00e9rie intitul\u00e9e BLUE PLANET II. Narr\u00e9e par Sir David Attenborough, l&#8217;\u00e9mission a non seulement apport\u00e9 les cr\u00e9atures des profondeurs sur nos \u00e9crans, mais aussi les probl\u00e8mes \u00e9cologiques caus\u00e9s par les d\u00e9chets plastiques.  <\/p>\n<p>Les questions entourant l&#8217;approvisionnement \u00e9thique et durable des produits ainsi que le recyclage ne nous sont pas nouvelles. Cependant, il y a un int\u00e9r\u00eat croissant des consommateurs pour l&#8217;achat de produits provenant de sources qu&#8217;ils per\u00e7oivent comme faisant du bien social ou environnemental. <\/p>\n<p>Une \u00e9tude produite par Unilever en janvier 2017 a montr\u00e9 qu&#8217;un tiers des consommateurs (33 %) pr\u00e9f\u00e9raient acheter des biens qu&#8217;ils percevaient comme \u00e9thiques plut\u00f4t que d&#8217;autres<sup>\u00b9<\/sup>. Les d\u00e9penses \u00e9thiques repr\u00e9sentent maintenant un march\u00e9 de 81,3 milliards de livres sterling au Royaume-Uni et continuent de cro\u00eetre. Il existe une opportunit\u00e9 estim\u00e9e \u00e0 966 milliards d&#8217;euros pour les marques qui rendent claires leurs r\u00e9f\u00e9rences de durabilit\u00e9\u00b9.  <\/p>\n<p>Les entreprises peuvent rendre ces r\u00e9f\u00e9rences claires aux consommateurs gr\u00e2ce \u00e0 l&#8217;utilisation de marques ou de logos associ\u00e9s \u00e0 une caract\u00e9ristique \u00e9thique ou durable. Deux fa\u00e7ons dont ces marques ou logos peuvent \u00eatre prot\u00e9g\u00e9s en tant que propri\u00e9t\u00e9 intellectuelle sont : les marques de certification et les marques commerciales. <\/p>\n<h5>Que sont les marques de certification<\/h5>\n<p>Une marque de certification est une marque qui indique aux consommateurs que les biens ou services qu&#8217;ils ach\u00e8tent sont certifi\u00e9s par rapport \u00e0 un certain ensemble de caract\u00e9ristiques, par exemple l&#8217;origine, les mat\u00e9riaux, le mode de fabrication des biens ou la performance des services, la qualit\u00e9, la pr\u00e9cision, etc. Le but d&#8217;une marque de certification est de distinguer les biens ou services qui sont certifi\u00e9s de ceux qui ne le sont pas. <\/p>\n<p>Les exemples incluent :<\/p>\n<p><strong><em>Normes alimentaires assur\u00e9es<\/em><\/strong><\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-8956\" src=\"https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2020\/08\/Assured-food-standards.png\" alt=\"\" width=\"171\" height=\"189\"><\/p>\n<p><em><strong>Carbon Trust Footprinting Company Limited<\/strong><\/em><\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-8972\" src=\"https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2020\/08\/working-with-carbon-trust.png\" alt=\"\" width=\"139\" height=\"187\"><\/p>\n<p><em><strong>D\u00e9tenue par Cruelty Free International<\/strong><\/em><\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-8964\" src=\"https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2020\/08\/cruelty-free_159x118.png\" alt=\"\" width=\"159\" height=\"118\"><\/p>\n<p>Les marques de certification sont demand\u00e9es aupr\u00e8s de l&#8217;UKIPO de la m\u00eame mani\u00e8re que les autres marques commerciales, mais doivent \u00eatre compl\u00e9t\u00e9es dans les 3 mois de la date de d\u00e9p\u00f4t avec des r\u00e8glements r\u00e9gissant l&#8217;utilisation de cette marque. Similairement aux marques commerciales \u00ab ordinaires \u00bb, les demandes de marques de certification sont examin\u00e9es par l&#8217;UKIPO sur des motifs absolus et relatifs. <\/p>\n<p>De plus, elles doivent remplir les crit\u00e8res suivants :<\/p>\n<ul>\n<li>Le demandeur d&#8217;une marque certifi\u00e9e ne doit pas exercer d&#8217;activit\u00e9 commerciale dans les biens ou services certifi\u00e9s. En cons\u00e9quence, si l&#8217;UKIPO identifie lors de son examen que le demandeur est \u00e9galement propri\u00e9taire d&#8217;une marque commerciale ordinaire ant\u00e9rieure couvrant des biens ou services identiques \u00e0 ceux de la marque de certification, cela sera pris comme une indication prima facie que le propri\u00e9taire de la marque de certification exerce \u00e9galement une activit\u00e9 commerciale dans ces biens ou services. Par cons\u00e9quent, un refus sera \u00e9mis. Un organisme ind\u00e9pendant doit donc demander la marque.   <\/li>\n<\/ul>\n<ul>\n<li>Le demandeur doit \u00eatre comp\u00e9tent pour certifier les biens et services pour lesquels la marque doit \u00eatre enregistr\u00e9e.<\/li>\n<\/ul>\n<h5>Protection en utilisant les marques commerciales<\/h5>\n<p>Contrairement aux marques de certification, il n&#8217;y a pas de restriction sur le demandeur de ne pas exercer d&#8217;activit\u00e9 commerciale dans les biens ou services certifi\u00e9s, ni qu&#8217;il soit comp\u00e9tent pour certifier les biens ou services. En cons\u00e9quence, les marques commerciales ordinaires peuvent \u00eatre la meilleure option pour les d\u00e9taillants et les fabricants, en particulier, qui souhaitent prot\u00e9ger un logo ou une marque qui signifiera que leurs produits sp\u00e9cifiques ont une caract\u00e9ristique \u00e9thique ou durable. <\/p>\n<p>Cependant, il y a deux questions qui doivent \u00eatre gard\u00e9es \u00e0 l&#8217;esprit lors de la prise de cette voie :<\/p>\n<ol>\n<li>La marque ou le logo doit encore remplir les exigences inh\u00e9rentes d&#8217;enregistrabilit\u00e9 quant au caract\u00e8re distinctif pour \u00eatre accept\u00e9 par l&#8217;UKIPO. Il ne peut donc pas \u00eatre exclusivement descriptif ou non distinctif par rapport aux biens ou services. <\/li>\n<li>Les consommateurs doivent encore \u00eatre capables de distinguer les biens et services comme provenant d&#8217;une entreprise sp\u00e9cifique plut\u00f4t que d&#8217;\u00eatre utilis\u00e9s \u00e0 travers plusieurs entreprises ou il y a un risque que la marque devienne g\u00e9n\u00e9rique ou descriptive. Cela pourrait alors conduire \u00e0 ce que l&#8217;enregistrement devienne vuln\u00e9rable \u00e0 l&#8217;annulation \u00e0 l&#8217;avenir. <\/li>\n<\/ol>\n<h5>Conclusion<\/h5>\n<p>Les avantages d&#8217;une marque de certification par rapport \u00e0 une marque commerciale ordinaire sont que le consommateur n&#8217;a pas besoin de l&#8217;associer \u00e0 une entreprise particuli\u00e8re. Cependant, comme elles ne peuvent pas \u00eatre d\u00e9tenues par des parties qui exercent \u00e9galement une activit\u00e9 commerciale dans les biens ou services d&#8217;int\u00e9r\u00eat, elles ne peuvent souvent pas \u00eatre utilis\u00e9es par les fabricants ou les d\u00e9taillants. <\/p>\n<p>En cons\u00e9quence, pour les fabricants et les d\u00e9taillants, les marques commerciales ordinaires sont encore probablement la meilleure option pour prot\u00e9ger de tels logos ou marques.
