La question de la fabrication d&#8217;\u00e9quipement d&#8217;origine (\u00ab OEM \u00bb) en Chine est d&#8217;une importance cruciale pour les d\u00e9taillants. Bien que de nombreux d\u00e9taillants ne commercent pas activement sur le march\u00e9 chinois, ils s&#8217;approvisionnent sans aucun doute en de nombreux produits aupr\u00e8s de l&#8217;\u00ab usine du monde \u00bb et beaucoup de ces produits sourc\u00e9s porteront leurs marques.  <\/p>\n<p>\u00c9tant donn\u00e9 l&#8217;importance primordiale des \u00ab d\u00e9tourneurs de marques \u00bb et de la s\u00e9curit\u00e9 de la cha\u00eene d&#8217;approvisionnement, la question de savoir si la fabrication de produits de marque en Chine uniquement pour l&#8217;exportation (utilisation de marque OEM) constitue une utilisation aux fins de contrefa\u00e7on de marque est un sujet important.<\/p>\n<p>La Cour supr\u00eame du peuple (\u00ab CSP \u00bb) dans la d\u00e9cision historique Pretul (novembre 2015) a statu\u00e9 que l&#8217;utilisation OEM ne constituait pas une utilisation en Chine et ne constituait donc pas une contrefa\u00e7on de marque, ce qui signifie essentiellement que le propri\u00e9taire d&#8217;un enregistrement de marque chinoise ne pouvait pas emp\u00eacher l&#8217;exportation de produits OEM de marque de Chine vers un pays tiers. Il y a eu une certaine incertitude sur cette question, \u00e9tant donn\u00e9 l&#8217;incoh\u00e9rence des d\u00e9cisions des tribunaux chinois. Cela semble maintenant \u00eatre termin\u00e9, avec la CSP, la plus haute cour de Chine, rendant une deuxi\u00e8me d\u00e9cision dans l&#8217;affaire Dongfeng.  <\/p>\n<h5>La certitude arrive avec Dongfeng<\/h5>\n<p>La situation factuelle autour de l&#8217;affaire Dongfeng n&#8217;est pas sans rappeler celle de Pretul. Le titulaire de la marque, Shanghai Diesel Engine Co. (\u00ab SDEC \u00bb), \u00e9tait propri\u00e9taire d&#8217;enregistrements de marques chinoises pour un logo incorporant le mot DONGFENG, qui signifie \u00ab vent d&#8217;est \u00bb en anglais, pour les moteurs diesel depuis le d\u00e9but des ann\u00e9es quatre-vingt. Le d\u00e9fendeur PT Adi, une soci\u00e9t\u00e9 indon\u00e9sienne, \u00e9tait propri\u00e9taire d&#8217;un enregistrement de marque indon\u00e9sienne pour la marque identique depuis 1987 pour des produits identiques. SDEC avait \u00e9chou\u00e9 dans son opposition \u00e0 l&#8217;enregistrement de ladite marque indon\u00e9sienne.   <\/p>\n<p>En 2013, PT Adi a pass\u00e9 des commandes aupr\u00e8s du fabricant OEM chinois Changjia pour fabriquer et livrer des moteurs diesel portant la marque DONGFENG en Indon\u00e9sie. Lorsque ces marchandises \u00e9taient pr\u00eates \u00e0 \u00eatre export\u00e9es, les douanes chinoises ont saisi les produits de marque, bien qu&#8217;en fin de compte ces marchandises aient \u00e9t\u00e9 lib\u00e9r\u00e9es et envoy\u00e9es \u00e0 l&#8217;exportation, car les douanes n&#8217;\u00e9taient pas s\u00fbres que le produit soit authentique ou non. Cependant, l&#8217;histoire ne s&#8217;est pas arr\u00eat\u00e9e l\u00e0 car en janvier 2014, SDEC a engag\u00e9 une proc\u00e9dure pour contrefa\u00e7on de marque contre PT Adi pour la violation de ses enregistrements de marques chinoises.  <\/p>\n<p>En premi\u00e8re instance, le tribunal populaire de Changzhou a statu\u00e9 en faveur de PT Adi, estimant qu&#8217;il n&#8217;y avait pas de contrefa\u00e7on de marque car l&#8217;utilisation OEM n&#8217;avait pas signifi\u00e9 que les produits de marque avaient \u00e9t\u00e9 mis sur le march\u00e9 en Chine, et donc l&#8217;utilisation de DONGFENG par PT Adi et en effet Changjia ne fonctionnait pas comme un badge d&#8217;origine commerciale sur le march\u00e9 int\u00e9rieur chinois. SDEC a fait appel de cette d\u00e9cision. <\/p>\n<p>La Haute Cour populaire du Jiangsu a ensuite statu\u00e9 en faveur de SDEC, soulignant l&#8217;incoh\u00e9rence dans les d\u00e9cisions des tribunaux chinois. La Haute Cour populaire du Jiangsu a tent\u00e9 de distinguer cette affaire de Pretul sur la base que Changjia savait que la marque DONGFENG \u00e9tait bien connue en Chine et associ\u00e9e \u00e0 SDEC et qu&#8217;elle avait manqu\u00e9 \u00e0 son devoir de v\u00e9rifier la validit\u00e9 des droits de marque de PT Adi et a estim\u00e9 que PT Adi avait faussement enregistr\u00e9 la marque DONGFENG en Indon\u00e9sie. PT Adi a sans surprise fait appel de cette d\u00e9cision, notamment compte tenu de la question de juridiction.  <\/p>\n<p>La CSP a statu\u00e9 en faveur de PT Adi dans l&#8217;appel. La CSP a de nouveau suivi la d\u00e9cision Pretul selon laquelle l&#8217;utilisation de marque OEM n&#8217;est pas une utilisation de marque sur le march\u00e9 chinois et ne constitue donc pas une utilisation qui porterait atteinte \u00e0 un enregistrement de marque chinoise et ne peut pas causer de confusion sur le march\u00e9 chinois. Elle a \u00e9galement estim\u00e9 que Changjia avait rempli son devoir de diligence car elle savait que PT Adi \u00e9tait propri\u00e9taire d&#8217;un enregistrement de marque indon\u00e9sienne pour la marque concern\u00e9e pour le produit couvert et que c&#8217;\u00e9tait la destination finale du produit export\u00e9.  <\/p>\n<p>Cette d\u00e9cision est logique et devrait \u00eatre accueillie favorablement par tous les d\u00e9taillants ayant d&#8217;importantes cha\u00eenes d&#8217;approvisionnement en Chine. Elle semble enfin apporter une certaine certitude \u00e0 la question de l&#8217;utilisation de marque OEM. <\/p>\n<p class=\"article-author-name p__medium\">Par Rebecca Field &#8211; Rebecca est directrice des marques de commerce dans le groupe sp\u00e9cialis\u00e9 en marques de commerce de HGF.
