Shanghai Yi Lang international co"},"content":{"rendered":"<p class=\"p__large\">Pendant de nombreuses ann\u00e9es, l&#8217;Office chinois des marques (CTMO) n&#8217;a pas accept\u00e9 les services de \u00ab vente au d\u00e9tail \u00bb dans la classe 35, au motif que la protection des services implique de fournir un service pour autrui, plut\u00f4t que la vente des propres produits d&#8217;un propri\u00e9taire de marque.<\/p>\n<p>Ces derni\u00e8res ann\u00e9es, il y a eu un certain assouplissement de cette pratique &#8211; en particulier lorsque les services de vente au d\u00e9tail de la classe 35 sont d\u00e9pos\u00e9s par le biais du syst\u00e8me international ou lorsque ces services concernent des produits m\u00e9dicaux, pharmaceutiques ou v\u00e9t\u00e9rinaires.<\/p>\n<p>Les tribunaux chinois reconnaissent que l&#8217;exclusion des services de vente au d\u00e9tail de l&#8217;enregistrement des marques est commercialement difficile et certaines d\u00e9cisions d\u00e9terminent la confusion, bien que la position reste impr\u00e9visible. Dans <em><strong>Shenzhen Milan Station Trading Co c. Milan Station (Hong Kong) Holdings Limited<\/strong><\/em> : le tribunal a estim\u00e9 que les \u00ab <em>services de vente au d\u00e9tail<\/em> \u00bb relevaient du champ d&#8217;application de la \u00ab <em>promotion des ventes (pour autrui)<\/em> \u00bb, et un raisonnement similaire a \u00e9t\u00e9 utilis\u00e9 pour d\u00e9terminer que les services de supermarch\u00e9 de vente au d\u00e9tail \u00e9taient similaires \u00e0 la \u00ab <em>promotion des ventes (pour autrui)<\/em> \u00bb ( <strong><em>TingChao (Cayman Islands (Holdings) Co. Ltd c. Min Fen <\/em>.<\/strong>).<\/p>\n<p>Fendi a fait l&#8217;exp\u00e9rience de l&#8217;impr\u00e9visibilit\u00e9 des tribunaux chinois sans protection pour les \u00ab <em>services de vente au d\u00e9tail<\/em> \u00bb dans une bataille prolong\u00e9e avec un importateur parall\u00e8le, Shanghai Yi Lang International Co. Ltd (\u00ab Yi Lang \u00bb). Yi Lang exploitait un magasin de vente Fendi en utilisant des produits Fendi import\u00e9s en parall\u00e8le de France et utilisait les marques \u00ab FENDI \u00bb sur l&#8217;enseigne ainsi que sur les sacs de shopping, les brochures publicitaires et leur compte WeChat officiel.  <\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-9004111222102487\" src=\"https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2021\/10\/Article-1-image-226x300.jpg\" alt=\"\" width=\"226\" height=\"300\" srcset=\"https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2021\/10\/Article-1-image-226x300.jpg 226w, https:\/\/img.hgf.com\/spio\/ret_img,q_cdnize,to_auto,s_webp:avif\/www.hgf.com\/wp-content\/uploads\/2021\/10\/Article-1-image.jpg 601w\" sizes=\"(max-width: 226px) 100vw, 226px\" \/><br \/>\nEn premi\u00e8re instance, devant un tribunal de district local, il a \u00e9t\u00e9 jug\u00e9 qu&#8217;il n&#8217;y avait pas de contrefa\u00e7on, bien que cela ait \u00e9t\u00e9 annul\u00e9 en deuxi\u00e8me instance par le Tribunal de la propri\u00e9t\u00e9 intellectuelle de Shanghai, qui a ordonn\u00e9 \u00e0 Yi Lang de payer 350 000 RMB \u00e0 Fendi en compensation. Yi Lang a demand\u00e9 que l&#8217;affaire soit renvoy\u00e9e devant la Haute Cour de Shanghai pour un nouveau proc\u00e8s et une d\u00e9cision finale. <\/p>\n<p>La Haute Cour de Shanghai a statu\u00e9 :<\/p>\n<ul>\n<li>L&#8217;utilisation de \u00ab FENDI \u00bb sur une enseigne constituait un service similaire \u00e0 ceux de la classe 35 car il y aurait des similitudes, par exemple, dans l&#8217;objectif, le contenu, les sujets, et que le public pertinent croirait qu&#8217;il existe certaines connexions.<\/li>\n<li>Le test d&#8217;usage loyal d\u00e9cid\u00e9 par les tribunaux de 1\u00e8re et 2\u00e8me instance a \u00e9t\u00e9 annul\u00e9, d\u00e9clarant qu&#8217;au lieu de la confusion, les tribunaux devraient \u00e9valuer les affaires sur :\n<ul>\n<li>si l&#8217;objectif est de bonne foi<\/li>\n<li>si la m\u00e9thode est raisonnable<\/li>\n<li>si l&#8217;usage correspond aux coutumes commerciales avec int\u00e9grit\u00e9<\/li>\n<\/ul>\n<\/li>\n<li>dans ce cas, Yi Lang a brouill\u00e9 les fronti\u00e8res entre les magasins de marque officiels et les magasins de vente autoris\u00e9s et en tant que tel, leur usage n&#8217;\u00e9tait pas loyal.<\/li>\n<\/ul>\n<p>Yi Lang a re\u00e7u l&#8217;ordre de cesser imm\u00e9diatement son usage contrefaisant et de payer une compensation \u00e0 Fendi.<\/p>\n<p>La d\u00e9cision est une bonne nouvelle pour les propri\u00e9taires de marques et montre effectivement le changement dans la pratique en Chine vers la pratique g\u00e9n\u00e9ralement accept\u00e9e adopt\u00e9e internationalement et les exigences plus commerciales des propri\u00e9taires de marques.
