{"id":9004111222137165,"date":"2021-08-03T14:43:24","date_gmt":"2021-08-03T13:43:24","guid":{"rendered":"https:\/\/www.hgf.com\/?p=9004111222137165"},"modified":"2026-05-13T14:52:25","modified_gmt":"2026-05-13T13:52:25","slug":"similarite-conceptuelle-la-cle-de-la-probabilite-de-confusion","status":"publish","type":"post","link":"https:\/\/www.hgf.com\/fr\/centre-de-connaissances\/articles\/similarite-conceptuelle-la-cle-de-la-probabilite-de-confusion\/","title":{"rendered":"Similarit\u00e9 conceptuelle \u2013 la cl\u00e9 de la probabilit\u00e9 de confusion ?"},"content":{"rendered":"<p class=\"p__large\"><span class=\"underline\">BareMinerals contre BareFace Minerals \u2013 affaire O\/060\/21 (janvier 2021)<\/span><\/p>\n<p class=\"p__large\">En mars 2020, Shiseido Americas Corporation (\u00ab SAC \u00bb) a d\u00e9pos\u00e9 une demande d&#8217;invalidation de l&#8217;enregistrement britannique n\u00b0 3114196 \u00ab BareFace Minerals \u00bb au nom de Bareface Cosmetics Limited (\u00ab BCL \u00bb). La marque a \u00e9t\u00e9 enregistr\u00e9e en 2015 et couvre les cosm\u00e9tiques en classe 3.<\/p>\n<p>SAC a fond\u00e9 l&#8217;invalidit\u00e9 sur ses enregistrements ant\u00e9rieurs britanniques et europ\u00e9ens pour la marque BAREMINERALS en classe 3, couvrant largement les cosm\u00e9tiques mais aussi la parfumerie et les lotions. SAC a cherch\u00e9 \u00e0 s&#8217;appuyer sur les dispositions 5(2)(b) \u2013 probabilit\u00e9 de confusion et 5(3) \u2013 r\u00e9putation et association ult\u00e9rieure. SAC a \u00e9galement revendiqu\u00e9 un caract\u00e8re distinctif accru de ses marques par l&#8217;usage.<\/p>\n<h5>Comparaison<\/h5>\n<p>SAC s&#8217;est appuy\u00e9 sur trois enregistrements ant\u00e9rieurs pour BAREMINERALS \/ bareMinerals couvrant les &#8216;<em>poudres cosm\u00e9tiques pour la peau et les yeux<\/em>&#8216; et, plus largement, les &#8216;<em>cosm\u00e9tiques<\/em>&#8216; en classe 3. L&#8217;enregistrement de BCL couvre les &#8216;cosm\u00e9tiques \u00e0 usage personnel ; maquillage pour le visage&#8217;. Les produits ont \u00e9t\u00e9 jug\u00e9s identiques, les cosm\u00e9tiques de SAC incorporant enti\u00e8rement les produits de BCL et \u00e9tant tr\u00e8s similaires en termes de produits de maquillage plus sp\u00e9cifiques de SAC.<\/p>\n<p>Concernant la comparaison des marques, l&#8217;Agent d&#8217;Audience (\u00ab AA \u00bb) a estim\u00e9 que la\/les marque(s) de SAC \u00e9taient intrins\u00e8quement distinctives \u00e0 un faible degr\u00e9. Il a \u00e9t\u00e9 consid\u00e9r\u00e9 que, compte tenu notamment de la publicit\u00e9 faite autour de la marque et de sa notori\u00e9t\u00e9 pour l&#8217;utilisation de min\u00e9raux, le sens de &#8216;bare&#8217; impliquerait &#8216;pur&#8217; ou &#8216;basique&#8217; min\u00e9raux. La publicit\u00e9 mentionn\u00e9e par l&#8217;Agent d&#8217;Audience a \u00e9t\u00e9 soumise par SAC eux-m\u00eames \u00e0 l&#8217;appui de leur cause, cependant, elle semble n&#8217;avoir fait que confirmer le raisonnement d\u00e9termin\u00e9 par l&#8217;AA concernant la signification conceptuelle de leur marque.<\/p>\n<p>On pourrait soutenir que le terme \u00ab bareminerals \u00bb, lorsqu&#8217;il est \u00e9valu\u00e9 par rapport aux produits, pourrait \u00eatre consid\u00e9r\u00e9 comme intrins\u00e8quement distinctif \u00e0 un faible degr\u00e9. Il n&#8217;est pas largement connu que les cosm\u00e9tiques sont faits de min\u00e9raux et ce n&#8217;est pas publicis\u00e9 de cette fa\u00e7on, \u00e0 l&#8217;exception de SAC et BCL. La commercialisation des produits de BCL ne semble pas avoir \u00e9t\u00e9 prise en compte, certainement pas dans la m\u00eame mesure que SAC, probablement en raison du fait qu&#8217;aucune preuve n&#8217;a \u00e9t\u00e9 soumise par eux. Il est \u00e9galement discutable que &#8216;BARE&#8217; puisse signifier &#8216;pur&#8217; ou &#8216;basique&#8217; et il semble que la signification ait \u00e9t\u00e9 d\u00e9termin\u00e9e via une \u00e9valuation \u00e0 la fois du second \u00e9l\u00e9ment de la marque et de la fa\u00e7on dont elle est publicis\u00e9e, plut\u00f4t que par des d\u00e9finitions de dictionnaire, une pratique \u00e0 laquelle nous sommes tous habitu\u00e9s lorsque nous traitons du caract\u00e8re distinctif et descriptif des marques.<\/p>\n<p>SAC a revendiqu\u00e9 un caract\u00e8re distinctif accru par l&#8217;usage de la marque et a soumis des preuves \u00e0 l&#8217;appui, notamment des chiffres de ventes, des chiffres et exemples publicitaires, des communiqu\u00e9s de presse et des d\u00e9tails sur les r\u00e9compenses. L&#8217;Agent d&#8217;Audience a rejet\u00e9 la demande au motif que les preuves, en particulier les chiffres de ventes, ne d\u00e9montraient pas de mani\u00e8re concluante l&#8217;utilisation sp\u00e9cifiquement au Royaume-Uni et qu&#8217;aucune part de march\u00e9 n&#8217;\u00e9tait indiqu\u00e9e.<\/p>\n<p>Les deux marques contiennent les \u00e9l\u00e9ments verbaux &#8216;BARE&#8217; et &#8216;MINERALS&#8217;. Les marques sont consid\u00e9r\u00e9es comme visuellement et phon\u00e9tiquement similaires. Cependant, l&#8217;ajout de &#8216;FACE&#8217; dans la marque de BCL modifie la signification conceptuelle \u00e0 un tel degr\u00e9 que l&#8217;Agent d&#8217;Audience a d\u00e9termin\u00e9 qu&#8217;il ne pouvait y avoir de risque de confusion, ni directe ni indirecte. L&#8217;Agent d&#8217;Audience explique que ce raisonnement est d\u00fb au fait que l&#8217;ajout du mot &#8216;FACE&#8217; cr\u00e9e une signification compl\u00e8tement diff\u00e9rente et impliquera que le maquillage utilis\u00e9 donnera \u00e0 l&#8217;utilisateur un visage d\u00e9couvert ou non dissimul\u00e9, c&#8217;est-\u00e0-dire une apparence naturelle. En comparaison, l&#8217;AA a d\u00e9termin\u00e9 que la signification de la marque de SAC concerne le produit lui-m\u00eame, plut\u00f4t que l&#8217;effet qu&#8217;il a sur l&#8217;utilisateur final, ce qui \u00e9tait \u00e9tay\u00e9 par la nature de sa publicit\u00e9 dans les preuves soumises.<\/p>\n<p>Il est int\u00e9ressant de noter que la demande d&#8217;invalidation a \u00e9t\u00e9 d\u00e9pos\u00e9e cinq ans apr\u00e8s que BCL ait obtenu son enregistrement, un point qu&#8217;ils ont soulev\u00e9 dans leur contre-d\u00e9claration. Peut-\u00eatre que cela, associ\u00e9 au fait qu&#8217;aucun cas de confusion r\u00e9elle n&#8217;a \u00e9t\u00e9 soumis dans les preuves de SAC, a soutenu la d\u00e9cision.<\/p>\n<p>L&#8217;Agent d&#8217;Audience a rejet\u00e9 la revendication de r\u00e9putation.<\/p>\n<h5>Points cl\u00e9s\/commentaires<\/h5>\n<p>Les preuves soumises par SAC \u00e9taient <em>prima facie<\/em> concluantes. Les commentaires de l&#8217;Agent d&#8217;Audience soulignent cependant la n\u00e9cessit\u00e9 d&#8217;\u00eatre m\u00e9thodique dans la soumission des preuves, particuli\u00e8rement en termes de chiffres de ventes et de d\u00e9monstration de la cr\u00e9ation ou du maintien d&#8217;une part de march\u00e9.<\/p>\n<p>On peut d\u00e9battre si l&#8217;ajout de &#8216;FACE&#8217; cr\u00e9e une telle diff\u00e9rence qu&#8217;il n&#8217;y aurait pas de risque de confusion, mais on ne peut pas contester le raisonnement logique de l&#8217;Agent d&#8217;Audience pour arriver \u00e0 cette conclusion. Cela change-t-il la donne lors de l&#8217;examen de ce qui semble \u00eatre une similarit\u00e9 directe des marques ? Oui, ce qui en soi apporte des avantages et des inconv\u00e9nients en \u00e9gale mesure, selon le c\u00f4t\u00e9 o\u00f9 l&#8217;on se trouve.
