Le d\u00e9p\u00f4t est devenu le sujet le plus tendance sur Twitter en quelques jours et a suscit\u00e9 de nombreux d\u00e9bats en ligne. <\/p>\n<p>La chenille <em>Colin<\/em> de M&amp;S n&#8217;est pas le seul g\u00e2teau sur le th\u00e8me de la chenille sur le march\u00e9, un certain nombre d&#8217;autres supermarch\u00e9s ayant leurs propres versions, notamment <em>Cecil<\/em> de Waitrose, <em>Wiggles<\/em> de Sainsbury, <em>Clyde<\/em> d&#8217;Asda et <em>Curly<\/em> de Tesco.<\/p>\n<h4>Les revendications potentielles<\/h4>\n<p>M&amp;S poss\u00e8de des enregistrements de marques britanniques qui couvrent le nom \u00ab&nbsp;COLIN THE CATERPILLAR&nbsp;\u00bb ainsi que l&#8217;emballage du produit. Il est tr\u00e8s probable que les revendications incluront la pratique du \u00ab&nbsp;passing-off&nbsp;\u00bb pour couvrir l&#8217;apparence du g\u00e2teau lui-m\u00eame, provenant de la client\u00e8le associ\u00e9e au produit. Afin de r\u00e9ussir sur cette base, M&amp;S devra d\u00e9montrer que l&#8217;offre <em>Cuthbert<\/em> d&#8217;Aldi nuit ou est susceptible de nuire \u00e0 cette client\u00e8le en pr\u00e9sentant Cuthbert comme <em>Colin<\/em>.  <\/p>\n<p>Aldi, comme beaucoup de marques de distributeur de supermarch\u00e9s, n&#8217;est pas \u00e9tranger aux \u00ab&nbsp;dupes&nbsp;\u00bb bien connus et s&#8217;est souvent retrouv\u00e9 avec des plaintes d\u00e9pos\u00e9es contre lui. Plus r\u00e9cemment, il y a eu la \u00ab&nbsp;bataille&nbsp;\u00bb qui s&#8217;est d\u00e9roul\u00e9e sur les m\u00e9dias sociaux avec Brewdog, qui a abouti \u00e0 une collaboration qui a ensuite \u00e9t\u00e9 vendue dans les magasins Aldi. <\/p>\n<p>La d\u00e9cision d&#8217;intenter ou non une action contre les dupes est un exercice d&#8217;\u00e9quilibre d\u00e9licat. Bien que les entreprises souhaitent prot\u00e9ger leurs marques, les consommateurs sont assez bien inform\u00e9s et savent souvent que les dupes ne sont pas la marque bien connue. En tant que tel, existe-t-il une association suffisante entre le dupe et la marque bien connue pour cr\u00e9er la fausse d\u00e9claration n\u00e9cessaire requise en vertu du \u00ab&nbsp;passing-off&nbsp;\u00bb&nbsp;?  <\/p>\n<p>Et pourquoi M&amp;S a-t-il pris position maintenant contre Aldi, alors qu&#8217;il a autoris\u00e9 d&#8217;autres g\u00e2teaux sur le th\u00e8me de la chenille sur le march\u00e9&nbsp;? De nombreux articles ont \u00e9t\u00e9 publi\u00e9s r\u00e9cemment comparant les diff\u00e9rentes chenilles et, de toutes les chenilles, celle d&#8217;Aldi est certainement la plus proche visuellement de <em>Colin<\/em>. Il se peut bien que le fait de franchir la ligne en passant de l&#8217;inspiration \u00e0 la copie flagrante soit ce qui a pouss\u00e9 M&amp;S \u00e0 agir.  <\/p>\n<p>Une affaire r\u00e9cente, <a href=\"https:\/\/campaigns.hgf.com\/retail-scanner\/issue-9\/article-5\/\">Freddy c. Hugz<\/a>, pourrait bien aider M&amp;S dans ses revendications du point de vue de la confusion post-vente, ce qui pourrait \u00e9largir l&#8217;efficacit\u00e9 du \u00ab&nbsp;passing-off&nbsp;\u00bb. Lorsqu&#8217;un produit a une forte r\u00e9putation dans sa pr\u00e9sentation, les consommateurs reconnaissant l&#8217;origine du produit, une \u00ab&nbsp;arnaque \u00e9vidente&nbsp;\u00bb peut montrer une intention claire d&#8217;induire en erreur. Le \u00ab&nbsp;passing-off&nbsp;\u00bb post-vente se produit lorsque les consommateurs continuent d&#8217;\u00eatre tromp\u00e9s quant \u00e0 l&#8217;origine du produit apr\u00e8s l&#8217;achat. Ainsi, m\u00eame s&#8217;il n&#8217;y a pas eu de tromperie ou de fausse d\u00e9claration au point de vente (c&#8217;est-\u00e0-dire un achat chez Aldi au lieu de M&amp;S), cela ne serait pas apparent apr\u00e8s la vente. Le copieur \u00e9vident aurait l&#8217;intention de maintenir le lien entre les produits et le propri\u00e9taire pendant la dur\u00e9e de vie du produit apr\u00e8s la vente (bien que dans ce cas, les g\u00e2teaux chenilles n&#8217;aient pas tendance \u00e0 durer aussi longtemps qu&#8217;une paire de jeans).    <\/p>\n<h4>Consid\u00e9rations suppl\u00e9mentaires relatives aux litiges dans un monde ax\u00e9 sur la technologie<\/h4>\n<p>Le signalement du d\u00e9p\u00f4t de la proc\u00e9dure judiciaire dans cette affaire a d\u00e9clench\u00e9 un engagement monumental sur les plateformes de m\u00e9dias sociaux, en partie en raison des r\u00e9actions imm\u00e9diates de l&#8217;\u00e9quipe des m\u00e9dias d&#8217;Aldi dans les jours qui ont suivi le d\u00e9p\u00f4t. Cela nous rappelle que non seulement la perspective juridique doit \u00eatre prise en compte, mais aussi la viabilit\u00e9 commerciale&nbsp;; quelles sont les implications d&#8217;une couverture m\u00e9diatique aussi vaste, m\u00eame si le jugement est en faveur de M&amp;S&nbsp;? <\/p>\n<p>Les deux entreprises ont adopt\u00e9 des approches tr\u00e8s diff\u00e9rentes en mati\u00e8re d&#8217;engagement sur les m\u00e9dias sociaux, Aldi allant \u00e0 fond avec un certain nombre de publications, de tweets et de hashtags.
