De plus, en septembre&nbsp;2015, il a \u00e9t\u00e9 signal\u00e9 que 30&nbsp;magasins Apple \u00e9taient en activit\u00e9 dans la ville de Shenzhen, mais Apple ne comptait qu\u2019un seul magasin officiel et 5&nbsp;revendeurs agr\u00e9\u00e9s dans la r\u00e9gion \u00e0 cette \u00e9poque.   <\/p>\n<p>La protection des formats de vente au d\u00e9tail est notoirement difficile dans la plupart des pays, notamment au Royaume-Uni et dans l\u2019Union europ\u00e9enne. Bien qu\u2019Apple ait r\u00e9ussi \u00e0 faire enregistrer son format de magasin en Allemagne lorsque son format minimaliste s\u2019est av\u00e9r\u00e9 s\u2019\u00e9carter consid\u00e9rablement des normes ou des usages du secteur \u00e9conomique concern\u00e9 par la Cour de justice de l\u2019Union europ\u00e9enne (\u00ab&nbsp;CJUE&nbsp;\u00bb), l\u2019enregistrement de tels formats en vertu du droit des marques peut \u00eatre difficile. Les probl\u00e8mes d\u2019enregistrement sont centr\u00e9s sur la d\u00e9finition pr\u00e9cise du format de vente au d\u00e9tail et, souvent, ces demandes doivent s\u2019appuyer sur la preuve d\u2019un caract\u00e8re distinctif acquis. Souvent, les formats de vente au d\u00e9tail doivent \u00eatre prot\u00e9g\u00e9s par une combinaison de droits d\u2019auteur, de dessins et mod\u00e8les, et par la protection du fonds commercial dans les \u00c9tats de common law tels que le Royaume-Uni, ce qui peut \u00e9galement \u00eatre difficile \u00e0 prouver et \u00e0 faire respecter.   <\/p>\n<p>Bien qu\u2019il ne soit toujours pas possible de couvrir sp\u00e9cifiquement les services de vente au d\u00e9tail dans les demandes et les enregistrements de marques chinois, une d\u00e9cision r\u00e9cente du tribunal populaire de Shijingshan de P\u00e9kin a renforc\u00e9 la protection des formats de vente au d\u00e9tail en Chine et, \u00e0 certains \u00e9gards, a rendu plus facile la protection de ces formats que dans de nombreux pays.<\/p>\n<p>Decathlon (Shanghai) Sports Products Co., Ltd a obtenu gain de cause contre un d\u00e9taillant chinois d\u2019articles de sport de plein air en vertu de la loi sur la concurrence d\u00e9loyale fond\u00e9e sur des droits non enregistr\u00e9s. Le march\u00e9 chinois est le deuxi\u00e8me march\u00e9 le plus important pour D\u00e9cathlon apr\u00e8s son march\u00e9 national, la France. Le d\u00e9taillant est pr\u00e9sent en Chine depuis&nbsp;2003. En&nbsp;2020, il exploitait trois cent treize&nbsp;magasins en Chine et, en&nbsp;2017, son chiffre d\u2019affaires en Chine d\u00e9passait les 10&nbsp;milliards de RMB. Une telle utilisation et une telle r\u00e9putation peuvent bien avoir aid\u00e9 D\u00e9cathlon dans ses efforts d\u2019application de la loi ici. Le tribunal populaire de Shijingshan de P\u00e9kin a estim\u00e9 que les deux parties \u00e9taient clairement en concurrence directe et D\u00e9cathlon a fait valoir que le format de ses magasins avait une allure saisissante et minimaliste. Le tribunal a estim\u00e9 que, bien que les formats des magasins ne soient pas identiques, les consommateurs penseraient que les styles sont similaires ou penseraient qu\u2019ils sont entr\u00e9s dans un magasin D\u00e9cathlon parce que les styles sont si similaires ou, selon les termes du tribunal, que le d\u00e9fendeur avait \u00ab&nbsp;appris de D\u00e9cathlon&nbsp;\u00bb.      <\/p>\n<p>Bien que le tribunal ait estim\u00e9 que la loi sur la concurrence d\u00e9loyale n\u2019\u00e9tait pas l\u00e0 pour emp\u00eacher l\u2019utilisation de formats ou de d\u00e9corations qui, dans une certaine mesure, impliquaient une certaine inspiration, il y avait une limite \u00e0 tracer, en particulier lorsqu\u2019il y avait copie directe de formats et de d\u00e9corations qui avaient une notori\u00e9t\u00e9 raisonnable sur le march\u00e9. D\u00e9cathlon a \u00e9videmment franchi cet obstacle et le d\u00e9fendeur a d\u00e9pass\u00e9 la limite de l\u2019inspiration. Cette d\u00e9cision est une bonne nouvelle pour les d\u00e9taillants qui exercent leurs activit\u00e9s en Chine et montre qu\u2019il n\u2019est pas n\u00e9cessaire de s\u2019appuyer uniquement sur les droits de propri\u00e9t\u00e9 intellectuelle enregistr\u00e9s dans les litiges chinois en mati\u00e8re de propri\u00e9t\u00e9 intellectuelle.  <\/p>\n<p>De plus, bien que les services de vente au d\u00e9tail ne puissent pas \u00eatre sp\u00e9cifiquement r\u00e9pertori\u00e9s dans les demandes et les enregistrements de marques chinois, il existe en effet des moyens de contourner cette difficult\u00e9, que nous avons soulign\u00e9s dans de pr\u00e9c\u00e9dents scanners de vente au d\u00e9tail. Les tribunaux chinois ont effectivement autoris\u00e9 la protection des services de vente au d\u00e9tail par d\u2019autres moyens. Dans l\u2019affaire Shenzhen Milan Station Trading Co c. Milan Station (Hong Kong) Holdings Limited&nbsp;: le tribunal a estim\u00e9 que les \u00ab&nbsp;<em>services de vente au d\u00e9tail<\/em>&nbsp;\u00bb entraient dans le champ d\u2019application des \u00ab&nbsp;<em>promotions des ventes (pour les autres)<\/em>&nbsp;\u00bb, et un raisonnement similaire a \u00e9t\u00e9 utilis\u00e9 pour d\u00e9terminer que les services de supermarch\u00e9 de vente au d\u00e9tail \u00e9taient similaires aux \u00ab&nbsp;<em>promotions des ventes (pour les autres)<\/em>&nbsp;\u00bb (TingChao (Cayman Islands (Holdings) Co. Ltd c. Min Fen.).  <\/p>\n<p>La le\u00e7on \u00e0 tirer de toutes ces affaires est peut-\u00eatre d\u2019\u00eatre cr\u00e9atif dans l\u2019examen de la protection des formats de vente au d\u00e9tail et des services de vente au d\u00e9tail en Chine.
