UK signs the UPC Protocol on Privilege and Immunities

As the first step in the UPC agreement ratification process, the UKIPO has confirmed that the UK signed the Protocol on Privilege and Immunities in Brussels on Wednesday 14 December.

Preparing for change: UK to Ratify UPC Agreement

The UK government has confirmed it is proceeding with preparations to ratify the Unified Patent Court Agreement. Despite the vote to Brexit, the UK government has announced it will continue with preparations for ratification over the coming months. This has come as a surprise to many who expected Brexit to be a barrier to ratification by the UK.

Another successful blockbuster: Court of Appeal finds in favour of Gilead’s Sovaldi

The Court of Appeal has dismissed Idenix Pharmaceuticals, Inc’s. (Idenix) appeal against Mr Justice Arnold Judgment revoking Indenix’s patent covering Flaviviridae compounds for treating Hepatitis C.

Grey goods are not so grey anymore: Court of Appeal confirms sale of ‘grey’ goods capable of being deemed a criminal offence

The recent Court of Appeal decision in R v C and Others [2016] EWCA Crim 1617 has confirmed that sale of grey goods can be met by criminal sanctions under Section 92 of the Trade Marks Act 1994 (‘the Act’), which can amount to a maximum of 10 years imprisonment.

No relief for Warner-Lambert as patent claims covering neuropathic pain held invalid

The Court of Appeal with Floyd LJ giving the leading Judgment, has upheld Mr Justice Arnold’s finding that Warner-Lambert’s patent covering use of pregabalin to treat pain was insufficient in part and that Warner-Lambert’s late application to amend in the UK was an abuse of process.
