Sofa Workshop Limited, a furniture retailer brought a claim against Sofaworks Limited, another UK retailer of furniture, alleging that Sofaworks use of the SOFAWORKS trade mark infringed two Community Trade Mark Registrations (“CTMs") for SOFA WORKSHOP and that Sofaworks had passed itself off as being associated with Sofa Workshop.

In the latest case before the CJEU concerning standard essential patents (SEPs) and anti-competitive behaviours (Huawei Technologies Co. Ltd v ZTE Corp., ZTE Deutschland GmbH C-170/13), the CJEU has set out the particular circumstances under which bringing an action for a prohibitory injunction against an alleged infringer by the proprietor of a standard-essential patent may constitute an abuse of a dominant position.

Cross Border DNIs Denied on Appeal

The Court of Appeal has set aside a declaration of non-infringement (DNI) in respect of the UK, French, Italian and Spanish designations of a European Patent which the UK High Court granted last May.
