Apple Retail Format– Ground breaking or just another Trade Mark?

The decision of the Court of Justice of the European Union (‘CJEU’) finding that in principle retail formats can be registered as trade marks throughout the European Union has been heralded by some commentators as ‘ground breaking’.
However, Lee Curtis and Rebecca Field, trade mark attorneys at HGF, in an article which appeared in the December/January 2015 edition of the World Trademark Review discuss whether the CJEU’s decision is truly ground-breaking or whether the Apple retail format trade mark can just be viewed as another trade mark.
