Appeal dismissed in Rihanna v TopShop passing off case

Back in 2013 the High Court held that the sale of substantial numbers of T-shirts bearing a photograph of world famous pop star Rihanna amounted to passing off. This was because although they had permission from the photographer to use the photograph, they did not have Rihanna’s consent to use her image.

Morocco to recognise European Patents as National Patents

On 19th January, the President of the EPO and the Moroccan Minister of Industry, Trade, Investment and the Digital Economy announced that an agreement allowing European patents to be validated in Morocco will enter into force on 1 March 2015.

Can an SPC be granted for an active ingredient covalently bonded to other active ingredients?

The judgement in another referral to the CJEU on the subject of SPCs, was given on 15 January 2015. This referral came from Austrian Patent Office regarding to application for an SPC for “Protein D”. The SPC application was based on a European patent relating to ‘Protein D ‒ an IgD-binding protein of Haemophilus influenzae’.
