HGF are successful in first trial before the Intellectual Property Enterprise Court
Judgement has been handed down today in the case of Manvers Engineering and others v Lubetech Industries and others.
The case was commenced in the Patents County Court, which became the Intellectual Property Enterprise Court (IPEC) just before trial in October 2013. The Judge found in favour of the defendants and held that the patent was valid but that none of the defendants’ products infringed. The defendants (advised by HGF) successfully deployed a squeeze argument, adopting the position that if the patent was interpreted so as to be valid over the prior art, then it would not cover the defendants’ products. The HGF team consisted of Chris Robinson, Kieran Killough and Martyn Fish.
