Changes to UK Design Law and the Intellectual Property Act 2014
The Intellectual Property Act received Royal Assent on 14 May 2014.
The UKIPO claims that the Act includes measures that will help clarify and modernise the Intellectual Property framework and simplify and improve design protection.
The UKIPO has produced guidance which is intended to help explain to designers, employers and businesses the changes to design law and sets out which of these will come into effect on 1 October 2014 and which are expected to come into force during 2015.
The guidance covers in particular the main changes regarding:
- Prior Use of Designs
- Intentional Copying (and criminal sanctions)
- Introduction of non-binding opinion service
